Terms & Conditions

These Terms & Conditions (“Terms”) apply to your use of promisepathcreations.com and to purchases made through it from Promise Path Creations LLC, a North Carolina limited liability company (“we”, “us”). By using the site or placing an order, you agree to these Terms. Please also read our Privacy Policy and Shipping & Returns policy, which are part of these Terms.
1. Who may buy
You must be at least 18 years old, or the age of majority where you live, to place an order. Our products are for children, but purchases must be made by adults.
2. Orders and acceptance
When you place an order, you are offering to buy the products in your order. We accept your order when we ship it. We may refuse or cancel any order, for example if a product is unavailable, the price or description is wrong, or we suspect fraud. If we cancel an order after you’ve paid, we will refund you in full.
3. Pricing and errors
Prices are in US dollars. Applicable sales tax may be calculated by Stripe Tax at checkout where required. We try to keep prices and descriptions accurate, but mistakes happen. If we find an error affecting your order, we will contact you and you can confirm the corrected order or cancel for a full refund. We may change prices at any time, but changes won’t affect orders we have already accepted.
4. Payment
Payment is processed by Stripe through Stripe Payment Links. By paying, you also agree to Stripe’s applicable terms. We never see or store your full card number. You confirm that you are authorized to use the payment method you provide.
5. Shipping and risk of loss
We ship to addresses in the United States only, and US shipping is free. Delivery times are estimates. Risk of loss and title to the products pass to you when the carrier delivers them to the shipping address you provided. See Shipping & Returns for details, including what to do about lost or damaged packages.
6. Returns and refunds
Returns, replacements and refunds are handled under our Shipping & Returns policy.
7. Amazon purchases
Our products are also sold on Amazon. “Buy on Amazon” links take you to Amazon.com. Purchases there are made from Amazon or through Amazon’s store and are governed by Amazon’s terms, policies and customer service, not these Terms.
8. Product use
Our products are intended for children ages 3 and up and should be used with adult supervision. Water pens contain small parts such as caps; keep them away from children under 3. Please follow any warnings on the packaging.
9. Content and intellectual property
All content on this site, including the Promise Path Creations name and logo, illustrations, product images and text, is owned by or licensed to Promise Path Creations LLC and protected by copyright and trademark law. You may view and share pages for personal, non-commercial use, but you may not copy, reproduce, sell or use our content or trademarks for any other purpose without our written permission. Bible verses quoted on this site are from the King James Version (KJV).
10. Acceptable use
Don’t misuse the site, for example by trying to disrupt it, gain unauthorized access, or use it for anything unlawful.
11. Disclaimer
Except as stated in our Shipping & Returns policy and to the fullest extent permitted by law, the site and products are provided “as is” and “as available”, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. Some states don’t allow these exclusions, so some of them may not apply to you.
12. Limitation of liability
To the fullest extent permitted by law, Promise Path Creations LLC and its owners will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the site or products. Our total liability for any claim related to an order is limited to the amount you paid for that order. Nothing in these Terms limits any liability that cannot be limited under applicable law, or any rights you have as a consumer that cannot be waived.
13. Governing law
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in or serving Union County, North Carolina, and you and we consent to their jurisdiction, except where your local consumer laws give you the right to bring a claim where you live.
14. Changes to these Terms
We may update these Terms from time to time. Changes apply to orders placed after the new effective date shown at the top of this page.
15. General
If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the policies they reference, are the entire agreement between you and us about your use of the site and purchases through it.
